TERMS & CONDITIONS

Welcome to Trusted Trail Canine Wellness. These Terms & Conditions (“Terms”) govern your access to and use of our website, purchases made directly from Trusted Trail, and certain matters relating to the use of Trusted Trail products (“Products”). By accessing or using our website or purchasing Products directly from Trusted Trail, you agree to be bound by these Terms.

1. Intended Product Use – FOR DOGS ONLY; NOT FOR HUMAN CONSUMPTION
Trusted Trail food Products are formulated, labeled, and sold for canine consumption only and are NOT FOR HUMANCONSUMPTION. Products should not be consumed by humans or administered to any animal other than a dog unless the product label expressly states otherwise.

2. Proper Use, Handling & Storage
Always review the Product’s ingredient information, feeding directions, warnings, calorie information, and other information appearing on the Product label before use. Products must be stored, handled, and used only as intended and in accordance with all instructions, feeding recommendations, storage directions, warnings, and other information appearing on the product packaging or label. Products should be stored securely and kept out of reach of children and other animals except when being intentionally provided in accordance with the Product label.

Do not use any Product that is expired, arrived with packaging or a seal that appears damaged or compromised, appears moldy, spoiled, contaminated, unusually discolored, or otherwise unsafe, or has been stored or handled in a manner inconsistent with the instructions appearing on the Product packaging.

Once purchased or delivered, you are responsible for proper storage, handling, and use of a Product.

3. No Guarantee of Results; Pet Owner Responsibility
Every dog is different. Trusted Trail does not warrant or guarantee that a Product will be appropriate or suitable for every dog, that every dog will respond to a Product in the same way, or that use of a Product will produce any particular health,
nutritional, behavioral, or other result.

You are responsible for reviewing the ingredients and determining whether a Product is appropriate for your dog based on age, size, breed, health, dietary needs, allergies, sensitivities, medications, and other individual circumstances. Consult your veterinarian before introducing a new Product if your dog has a medical condition, food allergy or sensitivity, is pregnant or nursing, takes medication, is on a restricted or prescription diet, or is otherwise under veterinary care.

Introduce new Products gradually and monitor your dog for adverse reactions. Discontinue use and contact your veterinarian if your dog experiences vomiting, diarrhea, itching, swelling, difficulty breathing, choking, unusual lethargy, or other concerning symptoms.

4. Treats for Supplemental Feeding Only
Unless otherwise stated on the Product label, Trusted Trail treats are intended for supplemental feeding only and are not intended to replace a complete and balanced diet. Follow the feeding recommendations on the Product label and adjust your dog’s regular food intake as appropriate to account for treat calories and to maintain a healthy weight.

5. Product Variations & Changes
Because food products may naturally vary, Products may differ slightly in appearance, color, shape, size, weight, texture, aroma, or other characteristics between pieces or production batches. We may also modify Product formulations, ingredients, packaging, sizing, or other characteristics from time to time.

6. No Veterinary or Medical Advice
Information provided by Trusted Trail through our website, Product packaging or labeling, social media, advertising, marketing materials, customer communications, or otherwise is provided for general informational purposes only and is not veterinary or medical advice. Nothing provided or sold by Trusted Trail is intended to diagnose, treat, cure, or prevent any disease or medical condition, or to replace professional veterinary advice, diagnosis, or treatment. Statements regarding ingredients, nutrition, wellness, or potential benefits should not be interpreted as guarantees regarding any individual dog’s health or response to a Product. Questions concerning your dog’s health, medications, or dietary needs should be directed to a licensed veterinarian.

7. Misuse of Products
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRUSTED TRAIL WILL NOT BE RESPONSIBLE FOR INJURY, ILLNESS, LOSS, OR DAMAGE TO THE EXTENT CAUSED BY MISUSE, IMPROPER ADMINISTRATION,OVERFEEDING, EXCESSIVE CONSUMPTION, IMPROPER STORAGE OR HANDLING, FAILURE TO FOLLOW
PRODUCT INSTRUCTIONS OR WARNINGS, USE OF A PRODUCT FOR AN UNINTENDED PURPOSE, CONSUMPTION BY A HUMAN OR AN ANIMAL OTHER THAN A DOG, OR USE OF A PRODUCT AFTER ITS APPLICABLE EXPIRATION DATE.

8. Warranty Disclaimer
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRUSTED TRAIL PROVIDES AND SELLS THE PRODUCTS “AS IS” AND DISCLAIMS ALL WARRANTIES, REPRESENTATIONS, AND CONDITIONS, EXPRESS OR IMPLIED, THAT MAY BE LAWFULLY DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Some jurisdictions do not permit the exclusion or limitation of certain warranties or consumer rights. Accordingly, some of the foregoing disclaimers may not apply to you. Nothing in these Terms is intended to exclude, limit, or disclaim any warranty, right, or remedy that cannot lawfully be excluded, limited, or disclaimed.

9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRUSTED TRAIL AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, CO-PACKERS, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE
DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO THE WEBSITE, A TRANSACTION THROUGH THE WEBSITE, THE PRODUCTS, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TRUSTED
TRAIL’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR PURCHASE TRANSACTION WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO TRUSTED TRAIL FOR THE PRODUCT OR ORDER GIVING
RISE TO THE CLAIM.

Nothing in these Terms excludes or limits liability to the extent that such liability cannot lawfully be excluded or limited. Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, the foregoing provisions apply only to the maximum extent permitted by law.

10. Indemnification
You agree to indemnify and hold harmless Trusted Trail and its members, managers, officers, employees, and agents from and against third-party claims, liabilities, losses, damages, and reasonable costs and expenses, including reasonable attorneys’ fees, to the extent arising out of or caused by your violation of these Terms, unlawful use of the Trusted Trail website, or misuse of a Product.

11. Purchases from Trusted Trail – Payment, Shipment & Delivery
An order confirmation only confirms Trusted Trail’s receipt of your order and does not constitute acceptance. Trusted Trail may refuse or cancel an order for pricing or availability errors, suspected fraud, unauthorized resale, payment issues, violations of these Terms, or other business reasons.

By placing an order, you represent that the information you provide is accurate, that you are authorized to use the payment method provided, and that the purchase is lawful. You authorize Trusted Trail and its payment processors to charge the payment method provided for Products, shipping, taxes, and other amounts disclosed at checkout.

Shipping options and applicable charges will be shown at checkout. Delivery dates are estimates only, and Trusted Trail is not responsible for delays caused by carriers or circumstances beyond our reasonable control. Please report lost, delayed, or damaged shipments promptly so we can attempt to assist in resolving the issue.

12. Third-Party Purchases
Trusted Trail Products may be sold through third-party retailers, distributors, marketplaces, or other sellers, and our website may link to or use third-party services. Trusted Trail does not control or assume responsibility for the practices, terms,
policies, representations, websites, services, or conduct of third parties.

Questions regarding a purchase from a third-party seller, including payment, shipping, cancellations, returns, or refunds, should be directed to that seller.

Product instructions, warnings, and safety information remain applicable regardless of where a Product is purchased.

13. Returns, Refunds, and Damaged or Incorrect Orders
This Section applies only to Products purchased directly from Trusted Trail through our website.

If an order arrives damaged, spoiled, incorrect, or with compromised packaging, please contact us promptly with your order number, a description of the issue, and photographs of the Product, packaging, and shipping label. If eligible, we may
replace the affected Product or refund the purchase price to the original payment method.

Purchases from third-party sellers are subject to that seller’s return and refund policies.

14. Product Concerns & Recalls
If you believe a Product may have caused or contributed to illness or injury, stop using the Product, contact your veterinarian as appropriate, and notify us promptly. If possible, retain the Product, packaging, purchase information, and photographs
of the Product and packaging to assist with our investigation and any required reporting.

If a recall, withdrawal, or other material safety notice affects a Product, we may post notice on our website and, where appropriate and reasonably practicable, contact affected customers directly.

15. Intellectual Property
Trusted Trail’s website and its contents, including text, photographs, graphics, logos, trademarks, service marks, Product names, designs, videos, and other materials, are owned by or licensed to Trusted Trail and are protected by applicable intellectual property laws. Subject to these Terms, Trusted Trail grants you a limited, personal, nonexclusive,nontransferable, revocable right to access and use the website for your personal, noncommercial use. No ownership rights are transferred to you by your use of the website or purchase of a Product.

16. Website Use
You may use Trusted Trail’s website only for lawful purposes. You may not interfere with the operation or security of the website, attempt to gain unauthorized access to the website or related systems, use the website to engage in fraud or other unlawful activity, or use automated means to scrape, copy, or extract website content without our permission.

17. Electronic Communications
By communicating with Trusted Trail electronically or placing an order through our website, you consent to receive transaction-related communications electronically, including order confirmations, shipping notices, customer service communications, safety information, recall notices, and other legally required notices.

18. Dispute Resolution, Governing Law, Jurisdiction & Forum
A. Pre-Suit Notice and Opportunity for Informal Resolution. Before filing any lawsuit or other claim against Trusted Trail arising out of or relating to these Terms, your use of the website, or any purchase made directly from Trusted Trail, you must first provide Trusted Trail with written notice using the contact information in Section 20. The notice must include a reasonably detailed description of the nature and basis of the dispute or claim and the relief sought, so that the parties have an opportunity to attempt to resolve the matter informally. You and Trusted Trail agree to engage in good-faith efforts to resolve the dispute before either party initiates legal proceedings.

B. Governing Law. These Terms and any dispute arising out of or relating to these Terms, your use of the website, or any purchase made directly from Trusted Trail are governed by the laws of the State of Michigan, without regard to choice of law principles. The United Nations Convention on Contracts for the International Sale of
Goods does not apply.

C. Jurisdiction and Forum. Any legal proceeding arising out of or relating to these Terms, the website, or any purchase made directly from Trusted Trail shall be brought exclusively in a state or federal court located in Michigan, and you and Trusted Trail consent to the personal jurisdiction of those courts.

19. General Terms

A. Changes to These Terms. Trusted Trail may update these Terms from time to time. Changes will become effective when the revised Terms are posted to Trusted Trail’s website unless a different effective date is stated.

B. Severability. If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

C. Entire Agreement. These Terms, together with any policies or additional terms expressly incorporated by reference and any terms expressly identified by Trusted Trail as applicable to a particular purchase in an order confirmation, receipt, or shipping document, constitute the entire agreement between you and Trusted Trail concerning your use of the website and any purchase made directly from Trusted Trail.
